Sir:

 

     Your Committee on Ways and Means, to which was referred S.C.R. No. 88 entitled:

 

"SENATE CONCURRENT RESOLUTION REQUESTING THE DEPARTMENT OF HEALTH TO ESTABLISH FEES THROUGH THE RULEMAKING PROCESS FOR THE LICENSURE, CERTIFICATION, AND RECERTIFICATION OF VARIOUS FACILITIES SEEKING LICENSURE OR CERTIFICATION BY THE DEPARTMENT,"

 

begs leave to report as follows:

 

     The purpose and intent of this measure is to request the Department of Health to exercise its power to establish fees through the rulemaking process for the licensure, certification, and recertification of various facilities seeking licensure or certification by the department.

 

     Your Committee received written comments in opposition to this measure from The Arc in Hawaii and three individuals.

 

     Your Committee finds that pursuant to section 32111.5, Hawaii Revised Statutes, the Department of Health may establish reasonable fees for the issuance or renewal of licenses, permits, variances, and various certificates required by law or by the department's rules.  Your Committee believes that the establishment of fees will produce fee revenues that will directly support the Department of Health's licensing and certification program.

 

     As affirmed by the record of votes of the members of your Committee on Ways and Means that is attached to this report, your Committee concurs with the intent and purpose of S.C.R. No. 88 and recommends its adoption.
