A BILL FOR AN ACT
Relating to Cesspool tax credits.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Section 235-16.5, Hawaii Revised Statutes, is amended by amending the definition of "qualified cesspool" in subsection (i) to read as follows:
"Qualified cesspool" means a cesspool that is certified by the department of health as being:
(1) Located within:
(A) Two hundred feet of a shoreline, perennial
stream, or wetland; [or]
(B) Two hundred feet of an existing sewer system; or
[(B)] (C) A source water
assessment program area (two year time of travel from a cesspool to a public
drinking water source); or
(2) A residential large capacity cesspool."
SECTION 2. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.
