A BILL FOR AN ACT
Relating to motor vehicle driver licensing.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Act 172, Session Laws of Hawaii 2015, relaxed driver licensing requirements to allow individuals unable to prove legal presence in the United States to apply for a limited purpose driver's license. In passing Act 172, the legislature desired to affect the number of unlicensed, uninsured motorists on the road and encourage undocumented foreign nationals to take steps toward legal presence.
The legislature finds that the low number of applications for the limited purpose driver's license and low number of licenses issued demonstrates that Act 172 is not the proper mechanism for accomplishing the aforementioned objectives.
Furthermore, a provision in Act 172 prohibits the use of information gathered for purposes of issuing the limited purpose driver's license or limited purpose provisional driver's license from being used as a basis for criminal investigation, arrest, or detention. The legislature finds that this provision forces law enforcement to turn a blind eye to the issue of legal status, in direct contravention of the duty to uphold the laws of the United States, to wit, immigration laws.
SECTION 2. Act 172, Session Laws of Hawaii 2015, is repealed.
SECTION 3. This act shall take effect upon its approval.
