A BILL FOR AN ACT

relating to the employer-union health benefits trust fund.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

     SECTION 1.  The legislature finds that health benefits plans established by the employer-union health benefits trust fund are exempt from new covered benefits requirements applicable to the State's insurance code.  The legislature further finds that these covered benefits should be included in all health benefits plans established by the employer-union health benefits trust fund.

     Accordingly, the purpose of this Act is to require health benefits plans under chapter 87A, Hawaii Revised Statutes, to include all benefits required under article 10A of chapter 431, Hawaii Revised Statutes, article 1 of chapter 432, Hawaii Revised Statutes, and chapter 432D, Hawaii Revised Statutes.

     SECTION 2.  Section 87A-16, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:

     "(a)  The board shall establish the health benefits plan or plans[, which shall be exempt from the minimum group requirements of chapter 431].  Notwithstanding any other law to the contrary, the board shall require the health benefits plan or plans to include all benefits required under article 10A of chapter 431, article 1 of chapter 432, and chapter 432D."

     SECTION 3.  Section 87A-19, Hawaii Revised Statutes, is amended by amending subsection (b) to read as follows:

     "(b)  The board shall establish the medical, hospital, or surgical benefits plan or plans[, which shall be exempt from the minimum group requirements of article 10A of chapter 431].  The medical, hospital, or surgical benefits plan or plans shall provide, pay for, arrange for, or reimburse the cost of medical, hospital, or surgical services, and may include prescribed hospital in-patient and out-patient service and medical benefits.  Notwithstanding any other law to the contrary, the medical, hospital, or surgical benefits plan or plans shall include all benefits required under article 10A of chapter 431, article 1 of chapter 432, and chapter 432D."

     SECTION 4.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect on July 1, 2016.
