A BILL FOR AN ACT

 

 

relating to an appropriation for the homeless.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The purpose of this Act is to make an appropriation to address homelessness.

     More specifically, this Act appropriates funds for non-recurring costs incurred for homeless shelters, projects, or programs.

     This Act also reduces the appropriation to the emergency and budget reserve fund under Act 202, Session Laws of Hawaii 2015, for fiscal year 2014-2015.  The reduction is equivalent to the appropriation made by this Act.  The legislature understands that the appropriation made by Act 202, Session Laws of Hawaii 2015, has not been expended.  Thus, the legislature chooses to use part of the appropriation made by Act 202, Session Laws of Hawaii 2015, to fund this Act.

     Because the appropriation made by Act 202, Session Laws of Hawaii 2015, was non-recurring, the legislature intends that the appropriation under this Act also be used for non-recurring purposes.  In essence, the legislature intends that this Act cause no net increase of appropriations under the financial plan for this and future fiscal bienniums.

     SECTION 2.  Act 202, Session Laws of Hawaii 2015, is amended by amending section 3 to read as follows:

     "SECTION 3.  There is appropriated out of the general revenues of the State of Hawaii the sum of [$10,000,000] $5,000,000 or so much thereof as may be necessary for fiscal year 2014-2015 to be deposited into the emergency and budget reserve fund by the director of finance."

     SECTION 3.  There is appropriated out of the general revenues of the State of Hawaii the sum of $5,000,000 or so much thereof as may be necessary for fiscal year 2016-2017 to fund the costs of developing emergency and transitional shelters for the homeless and other non-recurring costs of projects or programs to assist homeless families and individuals.

     The sum appropriated shall be expended by the department of human services for the purposes of this Act.

     SECTION 4.  Notwithstanding any law to the contrary, the appropriation under section 3 shall not lapse at the end of fiscal year 2016-2017; provided that any unexpended and unencumbered balance of the appropriation under section 3 shall lapse at the end of fiscal year 2019-2020.

     SECTION 5.  (a)  The department of human services shall submit an interim report to the legislature and governor on the actual and planned expenditures of the appropriation under section 3.  The report shall list the projects, programs, and expenditures that are planned or have been made as of December 31, 2016.  The report shall be submitted by no later than January 30, 2017. 

     (b)  The department of human services shall submit a final report to the legislature and governor on the expenditures of the appropriation under section 3.  The report shall list the projects, programs, expenditures, and encumbrances that are planned or have been made as of June 30, 2017.  If any amount of the appropriation was lapsed on June 30, 2017, the department shall provide the reason for allowing the portion of the appropriation to lapse.  The department shall submit the report by no later than September 30, 2017. 

     SECTION 6.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

 

     SECTION 7.  This Act shall take effect on July 1, 2016.

Homeless Projects and Programs; Appropriation

 

Description:

Appropriates $5 million in general funds for fiscal year 2016-2017 for the cost of developing emergency and transitional shelters and non-recurring costs of other homeless projects and programs.  Lapses the appropriation at the end of fiscal year 2019-2020 instead of fiscal year 2016-2017.  Reduces the general fund appropriation under Act 202, Session Laws of Hawaii of 2015, to the emergency and budget reserve fund by $5 million.  Requires the Department of Human Services to submit reports based on the expenditures of the appropriation.
