A BILL FOR AN ACT
relating to the elections commission.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 11, Hawaii Revised Statutes, is amended by adding two new sections to part I to be appropriately designated and to read as follows:
"§11- Elections commission; public meetings. Every meeting of the elections commission shall be subject to section 92-3. If an agenda item relates to a specific location in the State, the elections commission shall hold a public meeting to discuss that agenda item in that location. After the conclusion of the elections commission's meeting agenda, but prior to the elections commission voting on any agenda item, the elections commission shall provide for public comment on any agenda item; provided that the elections commission may vote on the adoption of its minutes and other ministerial matters prior to public comment.
§11- Elections commission; record of complaints and investigations; annual report. (a) The elections commission shall maintain a record of the number of complaints filed with the elections commission, the number of investigations conducted as a result of any filed complaints, and the disposition of all complaints and investigations. The record shall be a public document that is available for public inspection.
(b) The elections commission shall submit a written annual report to the legislature no later than twenty days prior to the convening of each regular legislative session. The annual report shall include:
(1) The activities of the elections commission;
(2) The number of complaints filed with the elections commission, the number of investigations conducted as a result of any filed complaints, and the disposition of all complaints and investigations; and
(3) Status, progress, or accomplishments of any initiatives of the elections commission."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.
