A BILL FOR AN ACT

 

 

relating to medical marijuana monitoring and research.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that Act 241, Session Laws of Hawaii 2015, provided for the establishment of a statewide medical marijuana dispensary system to enable qualifying patients to obtain medical marijuana.  Detailed monitoring and research conducted by the University of Hawaii's John A. Burns school of medicine in conjunction with that system would be of great value to the State.  The school of medicine is a scholarly body, independent from the dispensaries, that could study related health outcomes and safety issues and serve as an important tool to provide medical insight regarding the medical marijuana program.

     Accordingly, the purpose of this Act is to make an appropriation for the University of Hawaii's John A. Burns school of medicine to monitor and conduct research regarding the efficacy of medical marijuana dispensaries in the State and related health outcomes and safety issues.

     SECTION 2.  The University of Hawaii's John A. Burns school of medicine shall monitor and conduct research regarding the efficacy of medical marijuana dispensaries in the State and related health outcomes and safety issues, including but not limited to the efficacy of certifying qualifying patients to use medical marijuana and the toxicity and consistency of medical marijuana provided by dispensaries.  The school of medicine shall work from data provided by dispensaries in the State and shall not collect data on behalf of those dispensaries or do operational product testing or assays of marijuana chemical composition or similar laboratory-based measurements.

     The school of medicine shall submit a report of its findings to the legislature no later than twenty days prior to the regular sessions of 2017 and 2018.

     SECTION 3.  There is appropriated out of the general revenues of the State of Hawaii the sum of $         or so much thereof as may be necessary for fiscal year 2016-2017 for the University of Hawaii's John A. Burns school of medicine to monitor and conduct research regarding the efficacy of medical marijuana dispensaries in the State and related health outcomes and safety issues.

     The sum appropriated shall be expended by the University of Hawaii for the purposes of this Act.

     SECTION 4.  This Act shall take effect on July 1, 2016.
