A BILL FOR AN ACT
relating to medical marijuana dispensaries.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 329D, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§329D- County licenses. (a) Notwithstanding sections 329D-2(d), 329D-3, 329D-4, 329D-5, and 329D-7(B) to the contrary, each county in which dispensary licenses are authorized to be issued may apply for a dispensary license; provided that the counties shall be subject to:
(1) The dispensary license fee pursuant to section 329D-4(c); and
(2) The annual renewal fee pursuant to section 329D-4(n).
(b) The application for a county applicant shall be submitted to the department and shall include supporting documentation to establish that the county has committed sufficient resources to ensure financial stability and the capacity to comply and follow-through with the applicable requirements of this chapter and the rules of the department.
(c) The department shall adopt rules governing the timing, procedure, form, verification, and selection of county license applications."
SECTION 2. Section 329D-1, Hawaii Revised Statutes, is amended by amending the definition of "person" to read as follows:
""Person" means an individual,
firm, corporation, partnership, association, [or] any form of business
or legal entity[.], or any county."
SECTION 3. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
