A BILL FOR AN ACT

 

 

relating to works of art special fund.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 103-8.5, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:

     "(a)  There is created a works of art special fund, into which shall be transferred one per cent of all state fund appropriations for capital improvements designated for the construction cost element; provided that this transfer shall apply only to capital improvement appropriations that are designated for the construction [or renovation] of state buildings.  The one per cent transfer requirement shall not apply to appropriations from the passenger facility charge special fund established by section 261-5.5 and the rental motor vehicle customer facility charge special fund established under section 261-5.6."

     SECTION 2.  Section 103-8.5, Hawaii Revised Statutes, is amended by amending subsection (b) to read as follows:

     "(b)  [The] Fifty per cent of the expenditures of the works of art special fund shall be used solely to support art facilities, equipment, and supplies in department of education schools and fifty per cent of the expenditures of the works of art special fund shall be used solely for the following purposes:

     (1)  Costs related to the acquisition of works of art, including any consultant or staff services required to carry out the art in public places and relocatable works of art programs;

     (2)  Site modifications, display, and interpretive work necessary for the exhibition of works of art;

     (3)  Upkeep services, including maintenance, repair, and restoration of works of art; and

     (4)  Storing and transporting works of art."

     SECTION 3.  The auditor shall conduct an audit of the works of art special fund and the state foundation on culture and the arts on:

     (1)  The price paid for each art object acquired pursuant to section 103-8.5, Hawaii Revised Statutes, and currently owned by the State;

     (2)  An assessment of the current value of each art object acquired pursuant to section 103-8.5, Hawaii Revised Statutes, and currently owned by the State;

     (3)  A comparison of the price paid for each art object in paragraph (1) to the current value of that art object in paragraph (2); and

     (4)  An evaluation of how art objects are acquired by the State.

The auditor shall submit a report of its findings and recommendations, including any proposed legislation, to the legislature no later than twenty days prior to the convening of the regular session of 2017.

     SECTION 4.  There is appropriated out of the general revenues of the State of Hawaii the sum of $       or so much thereof as may be necessary for fiscal year 2016-2017 for the auditor to contract for the services of art appraisers to assist in producing the data for the audit required by this Act.

     The sum appropriated shall be expended by the auditor for the purposes of this Act.

     SECTION 5.  This Act shall take effect on July 1, 2016; provided that the amendments made by section 2 of this Act to section 103-8.5(b), Hawaii Revised Statutes, shall take effect on July 1, 2017.
