A BILL FOR AN ACT

 

 

relating to wages and hours.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 103, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§103-    Wages and hours of employees on leased public lands.  (a)  Prior to the offering of a lease of public lands in excess of $5,000 per year, the lessor public agency shall certify that:

     (1)  Services rendered on leased lands are performed by employees paid at wages or salaries not less than the wages paid to public employees for similar work; and

     (2)  The lessee complies with all federal and state laws regarding workers' compensation, unemployment compensation, hours, payment of wages, and safety standards.

     (b)  No lease of public land in excess of $5,000 per year shall be granted unless all conditions of subsection (a) are met.  Failure to comply with this section may result in cancellation of the lease, unless the noncompliance is corrected within a reasonable period of time, as may be determined by the department of labor and industrial relations.

     (c)  The department of labor and industrial relations shall adopt rules in accordance with chapter 91 for the purposes of this section.

     (d)  As used in this section, "public land" shall have the same meaning as in section 171-2."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 4.  This Act shall take effect upon its approval; provided that it shall apply to all leases entered into after January 1, 2017.
