A BILL FOR AN ACT
RELATING TO INSURANCE.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The legislature finds that consumer protection is extremely important to the State and that the roles of insurance appraisers and insurance umpires under the insurance code may need to be regulated to better protect the interests of the people of Hawaii.
The purpose of this Act is to require the office of the auditor to conduct a study on whether the scope of persons authorized to work as insurance appraisers and insurance umpires in the State needs to be further regulated to better serve the people of Hawaii.
SECTION 2. (a) The office of the auditor, with cooperation from the insurance division of the department of commerce and consumer affairs, shall conduct a study on the regulation of insurance appraisers and insurance umpires in the State. This study shall, at minimum, examine the following:
(1) Deficiencies in the current statutory framework for insurance appraisers and insurance umpires that may lead to confusion for consumers regarding the scope of persons that may provide insurance appraisers and insurance umpires services;
(2) How other states regulate insurance appraisers and insurance umpires; and
(3) If the regulation of insurance appraisers and insurance umpires is warranted in the State.
(b) The office of the auditor shall submit the study, including its findings, recommendations, and proposed legislation, if any, to the legislature no later than twenty days prior to the convening of the regular session of 2017.
SECTION 3. This Act shall take effect upon its approval.
