A BILL FOR AN ACT

 

 

relating to golf course liability.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 663, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§663-    Liability of golf courses.  (a)  If any golf equipment used on a golf course proximately causes property damage to any property outside of the property line of a golf course, the golf course shall be absolutely liable for the damage.

     (b)  It shall be an affirmative defense to the absolute liability that the damage was caused by a person who trespassed on the golf course.

     (c)  It shall be an affirmative defense to the absolute liability that the damage was caused by a person who acted negligently.

     (d)  As used in this section, "golf equipment" includes golf balls, golf clubs, or golf carts."
     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
