A BILL FOR AN ACT

 

 

RELATING TO TRANSPORTATION.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that many county roads are in disrepair.  Drivers pay, on average, $400 each year to repair damage to their vehicles caused by neglected and unmaintained roads.

     Accordingly, the purpose of this Act is to appropriate funds to incentivize the repair of county roads and highways.

     SECTION 2.  There is appropriated out of the general revenues of the State of Hawaii the sum of $12,000,000 or so much thereof as may be necessary for fiscal year 2015-2016 and the same sum or so much thereof as may be necessary for fiscal year 2016-2017 for a grant-in-aid to the several counties for the repair and repaving of county roads and to be allocated as follows:

     (1)  City and county of Honolulu:  $3,000,000;

     (2)  County of Hawaii:  $3,000,000;

     (3)  County of Kauai:  $3,000,000; and

     (4)  County of Maui:  $3,000,000;

provided that no funds shall be made available to any county unless the county provides matching funds equal to the amount appropriated for the purposes of this Act; provided further that the director of finance shall not release state matching funds appropriated by this Act until all matching county funds are encumbered by the respective county.

In addition to the matching requirement established in this section, in order to qualify for the state matching funds as appropriated by this Act, a county shall appropriate funds for the repair and repaving of county roads in an amount that exceeds the amount appropriated by the county for this purpose in its 2014-2015 budget.  Only funds that are appropriated for repair and repaving of county roads in a county's 2015-2016 and 2016-2017 budget, respectively, that are in excess of the 2014-2015 budget amount shall qualify for the state matching funds appropriated in this Act.  Furthermore, notwithstanding any other law to the contrary, any state matching funds appropriated under this section not released by the director of finance or encumbered by a respective county by June 30, 2018, shall lapse as of that date.

     The sums appropriated shall be expended by the respective counties for the purposes of this Act.

     SECTION 3.  This Act shall take effect on July 1, 2015.
