RELATING TO CAREGIVING. Permits hospitals to allow patients the opportunity to designate a lay caregiver. Allows hospitals to include the designated lay caregiver in the patient's medical record, notify the lay caregiver prior to the patient's transfer or discharge, consult with the lay caregiver about the patient's discharge plan, and instruct the designated lay caregivers in after-care. RELATING TO THE KANEOHE BAY REGIONAL COUNCIL. Removes the superintendent of education from the Kaneohe bay regional council. Adds the administrator of the aquatic resources division in place of one member from the division. Designates the administrator of the aquatic resources division as the chair. Deletes the requirements that the chairperson of the council be a nongovernmental member and that the chairperson may not serve more than 2 consecutive years. Requires the Council to hold quarterly hearings on the status of the master plan. Requires the council to review and report on the continued relevance and need for changes in its powers, duties, and functions. (SD1)

RELATING TO ELECTRONIC SMOKING DEVICES. Includes electronic smoking devices within the definition of "tobacco products" under chapter 245, Hawaii Revised Statutes, thereby subjecting wholesalers, dealers, and retailers of electronic smoking devices to the same licensing and permitting requirements as wholesalers, dealers, and retailers of cigarettes and other tobacco products. Establishes an excise tax on electronic smoking devices equal to an unspecified per cent of the wholesale price of each electronic smoking device kit, electronic smoking device nicotine cartridge, or electronic smoking device nicotine refill sold, used, or possessed by a wholesaler or dealer on or after October 1, 2014. Amends Hawaii's anti-smoking statute to prohibit the use of electronic smoking devices in places open to the public and places of employment. RELATING TO HOUSING. Part I: Appropriates funds to the department of health for substance abuse treatment, mental health support services, and clean and sober housing services. RELATING TO SOLAR ENERGY. Requires a special use permit for solar energy facilities on class B or C land. Requires solar energy facilities placed within land with soil classified as overall productivity rating class B or C to occupy not more than thirty per cent of the acreage of the parcel, or twenty acres of land, whichever is lesser, or in the alternative, of two or more adjacent parcels having met the applicable county requirements for the joint development or joint lot use of those parcels. Requires the area occupied by the solar energy facility to also be made available for compatible agricultural activities at a lease rate that is at least fifty per cent below fair market rent for comparable properties. Requires the area occupied by the solar energy facility to also be made available for compatible agricultural activities. Defines "agricultural activities". Requires that solar energy facilities be decommissioned and removed within twelve months of the conclusion of operation. Sunsets on July 1, 2020. (SD3)

Prohibits legal guardians, trustees, and relatives from continuing to care for individuals with intellectual or developmental disabilities in a certified foster home. Defines "related" as related by blood or marriage or having a legal relationship between a certified caregiver and a foster adult. Permits minors with intellectual or developmental disabilities to age in place under certain conditions. Clarifies that certified adult foster homes dually certified as foster boarding homes shall not exceed a total of three individuals with intellectual or developmental disabilities. Does not impact the validity of certification of adult foster homes that are dually certified as foster boarding homes and in existence as of the effective date of this Act. Takes effect on 1/1/2050. Requires, rather than allows, the employees' retirement system to require any department or agency of the State or counties to furnish to the system certain payroll and personnel transaction information, including any changes or errors in payments that require correcting or updating. Provides that if a department or agency fails to provide the information, the State or county is required to pay to the system, on the first day of the following fiscal year in which the failure occurred, an amount equal to the employer contributions payable by the State or county relative to that department or agency. Provides that if the required payment is not made on the first day of the fiscal year, any unpaid amounts shall bear interest and any subsequent payments shall be applied first to accrued interest and then to the required payment. RELATING TO PUBLIC EMPLOYMENT. Requires, rather than permits, hiring to be done in accordance with civil service laws when the state historic preservation division of the department of land and natural resources hires professional and technical staff. RELATING TO HAWAII COMMUNITY DEVELOPMENT AUTHORITY. Authorizes residential development on certain specified parcels of land owned by the office of Hawaiian affairs in Kakaako. Requires applicants for residential development to hold a public hearing regarding a plan or proposal for residential development in Kakaako and consider all written and oral submissions from the hearing prior to submitting the plan or proposal to HCDA for approval. Requires HCDA to hold a public hearing and fully consider all written and oral submissions received at the hearings held by the applicant and the HCDA prior to approving any plan or proposal for residential development. Establishes a Kakaako makai association fee and Kakaako makai special account to fund various public services and projects in Kakaako. Exempts the Office of Hawaiian Affairs from section 206E-12, HRS, regarding the dedication of public facilities by developers as a condition of development in Kakaako. Effective 07/01/50. (SD2)

RELATING TO THE HAWAII HEALTH CONNECTOR. Effective July 1, 2014, lowers the number of members on the board of directors of the Hawaii health connector to twelve, with a maximum of nine total voting members. Removes members representing insurers and dental benefit providers from the board. Requires the governor to designate a state agency representative to serve as the official voting state representative member of the board. Requires all other state agency representatives to be ex officio nonvoting members. Requires the governor to notify the chair of the board regarding the selection of the designated voting and nonvoting state representative members of the board. Establishes procedures for filling vacancies on the board. Effective 07/01/2050. (SD1)
