RELATING TO SMOKING. Prohibits smoking on all public beaches.

RELATING TO PUBLIC LAND. Amends the legislative approval requirement for any exchange of public land for private land to require a majority vote in both houses.

RELATING TO CONSERVATION. Requires the DLNR to administer a permit program for grading and grubbing within shoreline areas of the State. Establishes penalties.

RELATING TO ANIMALS. Allows restrained dogs in state parks in designated areas that have access to the shoreline; limits the State's liability. Authorizes the DLNR to establish fines for violations.

RELATING TO COUNTY ZONING FOR GROUP LIVING FACILITIES. Authorizes counties to require group living facilities to meet zoning requirements regarding traffic safety and congestion, elevated noise levels, and commercial deliveries. Defines geographic separation as at least 2,000 feet.

RELATING TO LAND USE. Requires the office of planning to establish a detailed land classification of overall (master) productivity ratings every 20 years, beginning in 2014.

RELATING TO LAND USE. Requires the LUC to include, in conditional approvals of boundary changes, a date by which the boundary change is no longer valid if the conditions have not been met.

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony no later than 6:00pm the evening prior to the hearing. Testimony should indicate:
· Testifier's name with position/title and organization;
· The Committee(s) to which the comments are directed;
· The date and time of the hearing; and
· Measure number.
While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may be distributed to the Committee after the hearing.
Submit testimony in ONE of the following ways:
PAPER: 15 copies (including an original) to Room 328 in the State Capitol;
FAX: For testimony less than 5 pages in length, transmit to 808-586-8404 (Oahu) or 1-800-535-3859 (for Neighbor Islander without a computer to submit testimony through the website); or
WEB: For testimony less than 10MB in size, transmit from http://www.capitol.hawaii.gov/submittestimony.aspx.
Testimony submitted will be placed on the legislative website. This public posting of testimony on the website should be considered when including personal information in your testimony.
