RELATING TO DRIVING UNDER THE INFLUENCE.

Amends the definition of a habitual offender to also mean a person who was convicted of habitually operating a vehicle under the influence of an intoxicant prior to the instant offense of operating a motor vehicle under the influence of an intoxicant.  (HB1181 HD1)

Prohibits the office of the public guardian from petitioning for its own appointment as guardian of the person for an incapacitated person.  Authorizes the court to allow the office to manage a ward's financial assets where no conservatorship is in effect.

RELATING TO CHILD PROTECTION.

Establishes a preference for allowing a child to remain in the family home if it is more likely than not that the child will be safe from harm in the family home.  Provides that in certain circumstances, the court must consider whether the alleged or potential perpetrator of imminent harm, harm, or threatened harm should be removed from the family home rather than continuing the child's placement in foster care; provided that the child's family must bear the burden of establishing that it is in the child's best interests to remove the child, rather than the alleged or potential perpetrator from the family home.  Effective July 1, 2013.  (HB400 HD1)

Status

PROPOSING AN AMENDMENT TO THE HAWAII STATE CONSTITUTION TO REQUIRE DISCLOSURE OF THE NAMES OF JUDICIAL NOMINEES.

Amends the Constitution of the State of Hawaii to require the judicial selection commission to publicly disclose its list of nominees for appointment to the office of the chief justice, supreme court, intermediate appellate court, circuit courts, or district courts concurrently with its presentation of that list to the governor or the chief justice.

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing.  Testimony should indicate:

·     Testifier's name with position/title and organization;

·     The Committee(s) to which the comments are directed;

·     The date and time of the hearing; and

·     Measure number. 

 

While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may be distributed to the Committee after the hearing.

Testimony submitted will be placed on the legislative website.  This public posting of testimony on the website should be considered when including personal information in your testimony. Those wishing to provide oral testimony will be limited to two minutes.
