RELATING TO THE NURSING FACILITY SUSTAINABILITY PROGRAM.

Amends Act 156, Session Laws of Hawaii 2012, as amended by Act 142, Session Laws of Hawaii 2013, to continue the Nursing Facility Sustainability Program by extending the sunset date of the Act, updating the referral dates in the statute, and appropriating funding out of the nursing facility sustainability program special fund for fiscal year 2014-2015.  Exempts the nursing facility program special fund from central services expenses assessed under section 36-27, Hawaii Revised Statutes.

RELATING TO AGING.

Appropriates general funds to provide ongoing financial support to healthy aging programs and services.  Requires the Executive Office on Aging to conduct a public education and awareness campaign on long-term care and appropriates general funds for its support and evaluation.  Effective July 1, 2014.

Establishes mandatory minimum prison terms for certain offenses committed against persons sixty years of age or older.

RELATING TO CHILD PROTECTIVE PROCEEDINGS.

Requires child protective proceedings and records to be open to the public unless a party to the proceeding, other than an authorized agency, can prove by clear and convincing evidence that an open hearing or access to records would cause the child severe emotional distress.

RELATING TO NOTICE TO CHILDREN PURSUANT TO THE CHILD PROTECTIVE ACT.

The court, after a chapter 587A, Hawaii Revised Statutes, petition has been filed, shall issue a summons requiring the presence of the parents and other persons to be parties to the proceeding, except the child.  The petitioner is to notify the child of the hearing no less than twenty-four hours prior to the hearing.

RELATING TO CHILD ABUSE.

Specifies certain rights of a parent or guardian after the department of human services receives a report concerning child abuse or neglect.  Requires written notice to be provided to a parent or guardian at the time of any initial face-to-face-contact with a child's parent or guardian regarding reported child abuse or neglect.

Grants adopted individuals who have attained eighteen years of age, unfettered access to the adopted individual's sealed adoption records.

RELATING TO CHILD VISITATION.

Permits family courts to award reasonable visitation to primary caregivers under certain circumstances.  Establishes presumption that a parent's decision regarding visitation is in the best interests of the child, which may be rebutted by evidence that denial would cause harm to the child.  Identifies factors a court may consider in awarding visitation.  Grants the court discretion to place reasonable restrictions, including time limitations, on visitation.

RELATING TO CHILD VISITATION.

Permits family court to award reasonable visitation to grandparents of a child if denial of visitation would cause significant harm to the child.  Establishes presumption that visitation decisions by parent are in the best interests of the child.  Presumption may be rebutted by a preponderance of the evidence.  Identifies factors court may consider in awarding visitation.

RELATING TO PARENTAL RIGHTS.

Provides for involuntary termination of parental rights in cases of incest. Provides for denial of custody and visitation rights of convicted parent and preserves the custodial parent's right to court ordered child support.

Requires adult children to annually demonstrate educational enrollment to continue receiving child support.
