MAKING AN EMERGENCY APPROPRIATION TO THE DEPARTMENT OF HUMAN SERVICES FOR THE MED-QUEST DIVISION.

Makes an emergency appropriation from the general revenues of the State of Hawaii for fiscal year 2013-2014 to address the budget shortfall for the general support for health care payments program (HMS 902) in the Department of Human Services.  Effective upon approval.

RELATING TO THE GENERAL ASSISTANCE PROGRAM.

Allows the Department of Human Services to draw from other funds appropriated to the Department of Human Services to maintain the level of General Assistance benefits payments set at the beginning of each fiscal year for the entire fiscal year.

RELATING TO APPOINTMENT OF EXEMPT PERSONNEL IN THE DEPARTMENT OF HUMAN SERVICES FOR THE STATE MEDICAL ASSISTANCE PROGRAMS.

Director of Human Services may appoint and employ, professional staff, not subject to chapter 76, Hawaii Revised Statutes, when in the determination of the director the services to be performed are unique and essential to the execution of the functions of the state medical assistance programs.  Effective July 1, 2014.

RELATING TO MEDICAL ASSISTANCE FRAUD.

Amends section 346-43.5, Hawaii Revised Statutes, to clarify that fraudulently applying for or renewing medical assistance benefits is a class C felony, and to clarify the amount of restitution when the fraud is committed by a recipient of medical assistance benefits.  Amends the statute of limitations provision under section 701-108, Hawaii Revised Statutes, to include the offense of medical assistance fraud with other felony offenses involving fraud or deception.

RELATING TO THE ESTABLISHMENT OF THE INTERIM ASSISTANCE REIMBURSEMENT SPECIAL FUND.

Establishes a special fund, the Interim Assistance Reimbursement Special Fund, into which interim assistance reimbursements received from the Social Security Administration are deposited for repayment of State-funded financial assistance provided under the general assistance, aged, blind and disabled or temporary assistance for needy families for recipients who are retroactively approved for Supplemental Security Income and  authorizes the Department of Human Services to expend the funds for State-funded financial assistance programs.  Appropriation.
