RELATING TO UTILITIES REGULATION. Aligns statutory language regarding utility ratemaking with widely accepted utility ratemaking principles and ratemaking practices already applied in Hawaii by allowing utilities in the State the opportunity to earn a fair return on utility property that is "used and useful" for public utility purposes. RELATING TO PUBLIC UTILITIES. Increases the balance that may be retained in the public utilities commission special fund at the end of a fiscal year.

RELATING TO COUNTIES. Empowers counties to impose and enforce liens upon premises served for unpaid water or sewer charges after an opportunity to be heard under chapter 91, HRS. Repeals the authority of each county to take over from the State existing waterworks systems and sewer systems and to enlarge, develop, and improve the same. Effective 7/1/2050. (SD2)

RELATING TO THE STATE BUILDING CODE. Modifies the composition, quorum, and duties of the Hawaii state building code council and revises the state building code, including clarifying terminology, the code adoption process, and the staggering of code adoptions. Prohibits the state building code council from adopting provisions in the Hawaii state building codes that conflict with laws governing contractors. Appropriates unspecified funds to department of accounting and general services for council's operating costs, including staff salaries. Effective 07/01/2050. (SD2)

RELATING TO THE HURRICANE RESERVE TRUST FUND. Requires the interest and other moneys earned on the principal of the hurricane reserve trust fund to be deposited into the trust fund instead of being diverted to the general fund. Repeals 06/30/2019. (SD1)

RELATING TO CONDOMINIUMS. Establishes provisions for condominium association annual meetings and quorum requirements. Permits the board of an association to employ and discharge the managing agent of an association, subject to a vote of a majority of the unit owners at an association meeting. Provides an exemption for a condominium project in which a majority of the units have been submitted to one or more vacation plans, or in which one or more units has been submitted to a vacation plan established by the developer of the project or by an affiliate of the developers. RELATING TO SECURE AND FAIR ENFORCEMENT FOR MORTGAGE LICENSING ACT. Adds and amends definitions for clarity. Deletes exemptions for individuals facilitating mortgage loans for family members and family property. Clarifies requirements for branch managers. Requires a mortgage loan originator company to be open for business during posted business hours. Authorizes the commissioner of financial institutions or the commissioner's representative to conduct examinations or investigations of a mortgage loan originator company during regular business hours. Excludes certain information included in NMLS from confidentiality provisions of the law. Makes various housekeeping amendments. Effective 07/01/2050. (SD2)

RELATING TO MORTGAGE SERVICERS. Changes the annual license renewal date for mortgage servicers from June 30 to December 31 of each calendar year.

RELATING TO UNLICENSED CONTRACTOR FRAUD. Specifies that, for purposes of the offense of unlicensed contractor fraud, the "intent to deprive" may be formed before or after the person obtains or exerts control over the property of another.

RELATING TO PRIVATE GUARDS. Amends various provisions relating to private guards and individuals acting in a guard capacity by: reducing the continuing education requirement to four hours every two years; delaying the continuing education requirement to prior to the June 30, 2016, renewal cycle; and making permanent the registration and licensure requirements for private guards and individuals acting in a guard capacity by repealing the sunset date of Act 208, Session Laws of Hawaii 2010. RELATING TO LIQUOR LICENSE CLASSES. Removes requirement that a class 14 brewpub licensee manufacture not more than thirty thousand barrels of malt beverages on the licensee's premises during the license year. Establishes a new class 18 liquor license class for small craft producer pubs. Makes conforming amendments relating to liquor license classes. Effective 7/01/2050. (SD2)

RELATING TO SALES ADVERTISEMENTS FOR STOLEN PROPERTY. Establishes a criminal offense for advertising the sale of stolen property with the intent to commit theft. Effective 07/01/2050. (SD1)

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony no later than 24 hours prior to the hearing. Testimony should indicate:
· Testifier's name with position/title and organization;
· The Committee(s) to which the comments are directed;
· The date and time of the hearing; and
· Measure number.
While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may be distributed to the Committee after the hearing. Persons submitting testimony the day of hearing are required to bring in 20 copies for testimony to be accepted. Those wishing to provide oral testimony will be limited to two minutes.

Testimony submitted will be placed on the legislative website after the hearing adjourns. This public posting of testimony on the website should be considered when including personal information in your testimony.
