RELATING TO THE PUBLIC UTILITIES COMMISSION. Specifies that the public utilities commission is an autonomous agency of the State to be transferred from the department of budget and finance and assigned, for administrative purposes only, to the department of commerce and consumer affairs. Increases the compensation of the chair and commissioners of the public utilities commission. Clarifies the public utilities commission's authority concerning standard administrative practices, including operational expenditures and the hiring of personnel. Enables the chair of the public utilities commission to appoint, employ, and dismiss an executive officer to assist with managing the operations of the commission. Specifies that the executive director of the division of consumer advocacy shall be the consumer advocate in hearings before the public utilities commission. Appropriates funds for the transfer of the public utilities commission and for the hiring of an executive officer within the public utilities commission. Effective 07/01/2050. (SD1)

RELATING TO CONTINUING EDUCATION FOR MARRIAGE AND FAMILY THERAPISTS. Requires licensed marriage and family therapists to complete a minimum of forty-five hours of continuing education courses, including six hours in ethic courses, during each licensing renewal period, for the period beginning 1/1/2017, and thereafter. Effective 7/1/2050. (SD1)

RELATING TO TIME SHARES. Eliminates requirement that a manager of a foreign time share plan register in Hawaii as a time share plan manager. Requires the disclosure statement for an offering of a time share plan to disclose that the manager of a foreign time share plan is not registered under Hawaii's time share law. Recognizes that an association of time share owners may be any kind of nonprofit or not-for-profit entity. Makes housekeeping amendments. (SD1)

RELATING TO CONDOMINIUM ASSOCIATIONS. Proposed HD1: Clarifies that a condominium association's lien is subordinate to real property taxes, rather than to all taxes. Clarifies that a condominium association may assess unpaid uncommon fees against a purchaser, in addition to a mortgagee, who purchases a delinquent unit in a judicial or nonjudicial power of sale foreclosure. Clarifies that condominium association boards may only fill board vacancies to serve until the next annual or duly noticed meeting. Effective July 1, 2050

RELATING TO ASSISTING UNLICENSED CONTRACTORS. Clarifies that a contractor licensee who aids and abets an unlicensed contractor may be subject to additional discipline by the contractors license board.

RELATING TO CERTIFICATION OF GAS TANKLESS WATER HEATERS. Proposed HD1: Requires certification of gas tankless and non-gas tankless on-demand water heater from a North American certification organization, which shall include the Canadian Standards Association International; the Air-Conditioning, Heating, and Refrigeration Institute; Gas Appliance Manufacturers Association Certification Program, which list certified products and models. Effective July 1, 2014

RELATING TO ONLINE PROTECTION OF INDIVIDUAL RIGHTS. Applies provisions in chapter 481B, part II, relating to civil liability for bad faith registration of a domain name, determining bad faith intent, and good faith exception to individuals and business entities. Effective 07/01/2050. (SD1)

RELATING TO THE PROTECTION OF CHARITABLE ASSETS. Grants oversight authority to the attorney general over charitable assets regardless of the form in which they are held. Authorizes the attorney general to enforce the application of the charitable asset to prevent or remedy the misapplication, diversion, waste, or breach of duty in management of a charitable asset. Effective 07/01/2050. (SD1)

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony no later than 24 hours prior to the hearing. Testimony should indicate:
· Testifier's name with position/title and organization;
· The Committee(s) to which the comments are directed;
· The date and time of the hearing; and
· Measure number.
While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may be distributed to the Committee after the hearing. Persons submitting late testimony day of hearing are required to bring in 20 copies for testimony to be accepted. Those wishing to provide oral testimony will be limited to two minutes.

FAX: For testimony less than 5 pages in length, transmit to 808-586-8437 (Oahu) or 1-800-535-3859 (for Neighbor Islander without a computer to submit testimony through e-mail or the Web); or
WEB: For testimony less than 10MB in size, transmit from http://www.capitol.hawaii.gov/submittestimony.aspx.
Testimony submitted will be placed on the legislative website after the hearing adjourns. This public posting of testimony on the website should be considered when including personal information in your testimony.
