RELATING TO INSURANCE. Adopts revisions to the National Association of Insurance Commissioners' model laws on Credit for Reinsurance Model Act, Standard Valuation Law, Standard Nonforfeiture for Life Insurance, and Insurance Holding Company System Regulatory Act.

RELATING TO THE PUBLIC UTILITIES COMMISSION. Clarifies the Public Utilities Commission's authority concerning standard administrative practices, including operational expenditures and the hiring of personnel.

RELATING TO UTILITIES REGULATION. Amends portions of Hawaii's utility ratemaking laws so as to allow utilities in the State the opportunity to earn a fair return on utility property that is "used and useful" for public utility purposes.

RELATING TO MORTGAGE RESCUE FRAUD. Clarifies definition of "distressed property consultant" and specifies that attorneys must be licensed by, and engaged in the practice of law in, the State of Hawaii in order to fall within the class of exceptions to the definition of "distressed property consultant".

RELATING TO ASSOCIATION ALTERNATIVE POWER OF SALE FORECLOSURE PROCESS. Clarifies the parties that a homeowners association can serve through publication, after a hearing before a judge, in a nonjudicial foreclosure proceeding.

RELATING TO CRIMINAL HISTORY RECORD CHECKS FOR REAL ESTATE APPRAISERS. Authorizes criminal background checks for real estate appraisers as required by federal law.

RELATING TO CONSUMER PROTECTION. Prohibits persons licensed pursuant to chapters 453 and 463E, HRS, from prescribing more than a thirty-day supply of certain types of drugs. Prohibits the automatic refill of certain types of drugs.

RELATING TO CHARITABLE SOLICITATION. Requires certain disclosures on collection bins for donated clothing and household items by for profit and non profit organizations; clarifies registration requirement for Hawaii domiciled charitable organizations and by nonprofits covered by an IRS Group Exemption Ruling; authorizes the Attorney General to require electronic financial reporting by professional solicitors, imposes a late fee for late financial reports by professional solicitors; clarifies that commercial co-venturers must provide a final accounting within thirty days; clarifies exemptions from registration requirements; and makes other technical and housekeeping amendments to chapter 467B, Hawaii Revised Statutes.

RELATING TO THE PROTECTION OF CHARITABLE ASSETS. Enacts section 3 of the Model Protection of Charitable Assets Act that provides that the Attorney General has charitable oversight over charitable assets regardless of the form in which they are held; authorizes the Attorney General to enforce the application of the charitable asset and prevent or remedy breaches of fiduciary or other duty or the diversion or waste of a charitable assets.

RELATING TO THE UNIFORM CONTROLLED SUBSTANCES ACT. Updates Chapter 329, Hawaii Revised Statutes (HRS), to make it consistent with amendments in federal law on controlled substances. Amends sections 329-14 and 329-20, HRS, to add new controlled substances federally scheduled as required under section 329-11, HRS.

RELATING TO LIQUOR LICENSE CLASSES. Removes requirement that a class 14 brewpub licensee manufacture not more than thirty thousand barrels of malt beverages on the licensee's premises during the license year. Establishes a new class 18 liquor license class for small craft producer pubs. Makes conforming amendments relating to liquor license classes.

RELATING TO LIQUOR TAX LAW. Defines "barrel", "small brewery or brewpub", "small winery", and "small manufacturer". Establishes a tax rate of 23 cents per wine gallon on draft beer and beer other than draft beer that are brewed or produced by a small brewery or brewpub. Establishes a tax rate of 59 cents per wine gallon on still wine and sparkling wine produced by a small winery. Establishes a tax rate of $2.57 per wine gallon on distilled spirits produced by a small manufacturer.

RELATING TO INSURANCE. Requires an insurer in a first party insurance claim to pay the claimant a fair amount within thirty days of a demand for payment of insurance benefits.

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony no later than 24 hours prior to the hearing. Testimony should indicate:
· Testifier's name with position/title and organization;
· The Committee(s) to which the comments are directed;
· The date and time of the hearing; and
· Measure number.
While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may be distributed to the Committee after the hearing. Those wishing to provide oral testimony will be limited to two minutes.

Testimony submitted will be placed on the legislative website after the hearing adjourns. This public posting of testimony on the website should be considered when including personal information in your testimony.
