A BILL FOR AN ACT

 

 

relating to the impersonation of a law enforcement officer.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 710-1016.6, Hawaii Revised Statutes, is amended to read as follows:

     "[[]§710-1016.6[]]  Impersonating a law enforcement officer in the first degree.  (1)  A person commits the offense of impersonating a law enforcement officer in the first degree if, with intent to deceive, the person pretends to be a law enforcement officer, and [is armed with a firearm.]:

     (a) is armed with a firearm;

     (b)  intentionally or knowingly causes another person to apprehend a harmful or offensive contact;

     (c)  threatens violence to another person by an immediate show of force;

     (d)  threatens or attempts to confiscate or damage property of another person; or,

     (e)  threatens or attempts to exercise dominion or control over another person.

 

     (2)  Impersonating a law enforcement officer in the first degree is a class C felony."

     SECTION 2.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
