A BILL FOR AN ACT

 

 

RELATING TO THE DEPARTMENT OF LAND AND NATURAL RESOURCES.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that state planning in Hawaii typically fails to take into account the long-term consequences of plans and decisions and to be comprehensively proactive, instead opting to be reactive to circumstances.  The legislature further finds that long-term, comprehensive planning is needed.  Long-term planning is aimed at meeting future needs, usually estimated by extrapolation of present or known needs and projecting future desirable scenarios.  Comprehensive planning describes a process that determines community goals and aspirations in terms of community development.  The outcome of comprehensive planning is the comprehensive plan which dictates public policy in terms of transportation, utilities, land use, recreation, and housing. Comprehensive plans typically encompass large geographical areas, a broad range of topics, and a long-term time horizon.

     The legislature believes that the appropriation in this measure for the construction of amenities included in the Sand Island ocean recreation park master plan should be a long-term comprehensive master plan.

     SECTION 2.  (a)  The department of land and natural Resources and the Sand Island Business Association shall negotiate an even, fair, and equitable exchange of Sand Island Industrial Park property for other private properties.  The exchange shall be completed on or before June 30, 2014.

     (b)  The department of land and natural resources shall report to the legislature quarterly beginning October 1, 2013, on the progress of negotiating the exchange described under subsection (a).

     SECTION 3.  There is appropriated out of the general revenues of the State of Hawaii the sum of $21,000,000 or so much thereof as may be necessary for fiscal year 2013-2014 and the same sum or so much thereof as may be necessary for fiscal year 2014-2015 for the construction of amenities to be included in a long-term comprehensive master plan for Sand Island.

     The sums appropriated shall be expended by the department of land and natural resources for the purposes of this Act.

     SECTION 4.  There is appropriated out of the general revenues of the State of Hawaii the sum of $8,000,000 or so much thereof as may be necessary for fiscal year 2013-2014 and the same sum or so much thereof as may be necessary for fiscal year 2014-2015 for the general management and administration costs of the state parks division of the department of land and natural resources.

     The sums appropriated shall be expended by the department of land and natural resources for the purposes of this Act.

     SECTION 5.  This Act shall take effect upon its approval; provided that sections 3 and 4 shall take effect on July 1, 2013.
