A BILL FOR AN ACT
Relating to medical records.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Section 622-57, Hawaii Revised Statutes, is amended by amending subsection (g) to read as follows:
"(g) Reasonable costs incurred by a
health care provider in making copies of medical records shall be borne by the
requesting person[.]; provided that no copy costs shall be charged to
a patient, patient's attorney, or authorized representative if the medical
records are necessary to support a claim or appeal under any provision of the
Social Security Act, title 42 United States Code section 301 et seq., or for
state assistance pursuant to section 346-52."
SECTION 2. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.
