A BILL FOR AN ACT
RELATING TO THE DEPARTMENT OF EDUCATION.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The legislature finds that the needs and enrollment in Hawaii's public schools have shifted and changed over time. Many schools are at capacity and do not have the facilities to adequately handle continued growth, while others struggle to find space to deliver needed programs and services. While the department of education is currently addressing these concerns through the construction of portable classrooms and multi-track schools, the need to procure the lowest responsive, responsible bidder results in the department of education contracting with many different contractors. This creates inefficiencies and inconsistencies among public school campuses in the timeliness of receiving portables, as well as in the design and quality of such portables.
Fourth generation modular design building systems, such as the Sprout Space classrooms designed by the company Perkins+Will, are designed to enhance student learning by incorporating sustainable green building strategies that reduce energy costs, reduce construction costs, and create healthier learning environments. Such modular design buildings also provide flexibility in design and use.
The purpose of this Act is to create a five-year pilot project within the department of education to authorize the department of education to contract for the design, planning, and installation of fourth generation modular design buildings to maximize resources and better meet the growing and changing needs of Hawaii's public school campuses.
SECTION 2. (a) There is established within the department of education a five-year fourth generation modular design building pilot program.
(b) Under the pilot program, the department of education shall enter into a multi-year contract for the design, planning, and installation of fourth generation modular design buildings on Hawaii's public school campuses.
(c) For purposes of this Act, the department of education shall enter into a multi-year contract. The vendor shall be selected by the most appropriate procurement method including but not limited to sealed proposals, sealed bids, sole source, or other procurement methods as permitted by chapter 103D, Hawaii Revised Statutes, to specifically carry out the requirements of the pilot project.
(d) The department of education shall report to the legislature no later than twenty days prior to the convening of the regular session of 2015 and each regular session thereafter until the completion of the pilot project. The report shall include:
(1) A summary of the department of education's efforts to contract for the design, planning, purchasing, and installation of fourth generation modular design buildings;
(2) A copy of the contract entered into pursuant to this Act, if any;
(3) The criteria used by the department of education in selecting which public schools shall be part of the pilot project;
(4) A summary of any capacity and funding issues or challenges the department of education has encountered in carrying out the pilot project pursuant to this Act;
(5) A discussion of identified best practices as determined through the pilot project, and goals for system wide replication; and
(6) Any proposed legislation.
SECTION 3. There is appropriated out of the general revenues of the State of Hawaii the sum of $ or so much thereof as may be necessary for fiscal year 2014-2015 for the department of education to enter into a multi-year contract for the design, planning, purchasing, and installation of fourth generation modular design buildings on school campuses throughout the State.
The sum appropriated shall be expended by the department of education for the purposes of this Act.
SECTION 4. This Act shall take effect on July 1, 2050.
