A BILL FOR AN ACT

 

 

relating to electric vehicles.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 196, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§196‑    Electric vehicle charging systems; open access.  (a)  If an electric vehicle charging system requires payment of fees by users:

     (1)  The provider of the charging system may offer subscriptions, membership, discounts, or other inducements as otherwise permitted by law to consumers, but shall allow members of the general public to use the charging system by paying a fee without also requiring the paying of a subscription or obtaining membership in any club, association, or organization as a condition of using the charging system;

     (2)  Total actual charges for the use of an electric vehicle charging system shall be disclosed to a potential customer immediately prior to a transaction at the point of sale; and

     (3)  Payment of a fee shall be permitted via:

         (A)  Proximity recognition of a credit card or debit card;

         (B)  Swiping of a credit card or debit card;

         (C)  Electronic commerce transfers as allowed by the provider; or

         (D)  Other mobile technology.

     (b)  The service provider of an electric vehicle charging system, or the service provider's designee, shall disclose the following to the coordinator:

     (1)  The electric vehicle charging system's location;

     (2)  A schedule of all fees;

     (3)  Accepted forms of payment;

     (4)  Hours of accessibility by the general public to the electric vehicle charging system; and

     (5)  Other information as required by the coordinator.

     (c)  Electric vehicle charging systems shall be labeled in accordance with title 16 Code of Federal Regulations part 309.

     (d)  Electric vehicle charging systems shall be clearly marked with signage in the parking area or facility, where commercially reasonable and feasible, directing customers to the charging systems.

     (e)  If no interoperability billing standards have been adopted by a national standards organization by January 1, 2015, the coordinator may adopt interoperability billing standards.  All electric vehicle charging systems that require payment shall meet the interoperability billing standards adopted by the coordinator within one year of the adoption of those billing standards.  The coordinator shall consider other governmental or industry-developed interoperability billing standards and may adopt interoperability billing standards previously adopted by an outside authoritative body.

     (f)  For purposes of this section:

     "Electric vehicle charging system" has the same meaning as in section 196-7.5.

     "Interoperability billing standards" means the ability for a member of one electric charging system billing network to use another billing network."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect on January 1, 2015.

Ensures open access to electric vehicle charging systems by prohibiting the charging of a subscription fee or requiring membership in any club, association, or organization as a condition of using an electric vehicle charging system.  Imposes requirements regarding the disclosure of charges, acceptable forms of payment, and hours of accessibility; labeling; and adoption of interoperability billing standards for the use of electric vehicle charging systems.  Effective 01/01/2015.
