A BILL FOR AN ACT

 

 

RELATING TO THE HAWAII PUBLIC HOUSING AUTHORITY'S ADMINISTRATION OF THE FEDERAL HOUSING CHOICE VOUCHER PROGRAM.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 356D, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§356D-    Housing choice voucher program administration.  Only household members listed at the time of the issuance of a federal housing choice voucher may retain the voucher.  A voucher shall be returned to the authority upon the vacancy by the last original household member; provided that, where the original head or co-head of the household is survived by a minor or minors who were subsequently added to the household, the household may retain the voucher until the last of the minors who were added to the household reaches the age of twenty-one.  No legal guardian shall be added to the household to care for the minor or minors unless eligible for participation in the housing choice voucher program, and any legal guardian so added to the household shall not retain the voucher after the minor or minors reach the age of twenty-one."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect on July 1, 2050.

Description:

Allows only original household members to retain a federal housing choice voucher.  Requires vouchers to be returned to the Hawaii public housing authority when all original members are no longer in the household.  Allows minors who survive the original head or co-head of the household and were added to the household to retain the voucher until the last of the minors reaches the age of twenty-one.  Effective 7/1/2050.  (SD1)
