A BILL FOR AN ACT
relating to public order.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 711, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§711- Urinating or defecating on a paved road or sidewalk. (1) A person commits the offense of urinating or defecating on a paved road or sidewalk if the person intentionally or knowingly urinates or defecates on, or urinates or defecates in a manner so that the excreted material lands on, a paved road or sidewalk.
(2) As used in this section, "paved road or sidewalk" means any paved surface that is open for public vehicular or pedestrian use, including those that lead to or away from any building.
(3) This section shall not apply in cases where the person urinated or defecated on paved roads or sidewalks because of a medical condition verified by a licensed physician.
(4) Urinating or defecating on a paved road or sidewalk is a violation."
SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun, before its effective date.
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
