A BILL FOR AN ACT

 

 

RELATING TO THE DEPARTMENT OF EDUCATION.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§302A-    Fundraising and charitable activities; school projects.  Notwithstanding any law to the contrary, nothing shall prohibit a school or class from participating in fundraising or charitable activities, in conjunction with an organization that is exempt from federal taxes under section 501(c)(3) of the Internal Revenue Code and registered under section 467B-2.1 or granted an exception from registration under section 467B-2.1, as part of a school project when the fundraising or charitable activities benefit student learning pursuant to criteria established by the department pursuant to chapter 91."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
