A BILL FOR AN ACT

 

 

relating to the department of education.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 302A, Hawaii Revised Statutes, is amended by adding two new sections to be appropriately designated and to read as follows:

     "§302A-    Gifts and donations to department.  (a)  Notwithstanding any law to the contrary, the department may accept donations or gifts on behalf of the department, individual schools, or school complexes.

     (b)  Any donation or gift accepted by the department pursuant to this section shall be used to enhance the school environment, improve the administration of school programs, or benefit student learning in accordance with criteria established by the department pursuant to chapter 91.

     (c)  A private source making a gift or donation to the department shall be afforded the same protections provided by section 302A-1503.

     §302A-    Fundraising and charitable activities; school projects.  Notwithstanding any law to the contrary, nothing shall prohibit a school or class from participating in fundraising or charitable activities, in conjunction with an organization that is exempt from federal taxes under section 501(c)(3) of the Internal Revenue Code, as part of a school project when the fundraising or charitable activities benefit student learning pursuant to criteria established by the department pursuant to chapter 91."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
