A BILL FOR AN ACT

 

 

relating to Theft.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that transmission of energy is necessary for the well being of the State and its communities, and that copper wire is the most efficient means of transmitting energy.  However, theft of copper wire is a continuing problem that jeopardizes the well being of the State and its communities.

     The purpose of this Act is to establish that theft of copper is a class A felony if the copper is owned by the State or counties or is located on state or county property.

     SECTION 2.  Section 708-835.7, Hawaii Revised Statutes, is amended by amending subsection (2) to read as follows:

     "(2)  Theft of copper is a class C felony[.]; provided that theft of copper wire owned by the State or counties or located on state or county property is a class A felony."

     SECTION 3.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 4.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect upon its approval.
