A BILL FOR AN ACT
relating to programmatic agreements.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The purpose of this Act is to amend the definition of programmatic agreement to accurately reflect what is required in the phased review of certain projects by the department of land and natural resources by specifying the federal law pursuant to which programmatic agreements must be developed.
SECTION 2. Section 6E-2, Hawaii Revised Statutes, is amended by amending the definition of "programmatic agreement" to read as follows:
""Programmatic agreement" means
a document that sets forth the terms of a formal, legally binding agreement and
establishes a process for consultation[,] and review[, and
compliance with federal laws.] pursuant to section 106 of the National
Historic Preservation Act and its implementing regulations."
SECTION 3. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
