A BILL FOR AN ACT
MAKING AN APPROPRIATION TO THE DEPOSIT BEVERAGE CONTAINER DEPOSIT SPECIAL FUND.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The legislature finds that the deposit beverage container fee of five cents is a victim of its own success. The higher the redemption rate, the higher is the amount of refund payout. Section 342G-102, Hawaii Revised Statutes, provides for an automatic administrative adjustment of 1.5 cents per container if the redemption rate is greater than seventy per cent. The automatic fee increase of a half-cent fee increase was written into the bottle law from its inception to ensure that the recycling program could sustain itself and continue to pay back deposits to consumers. The department of health has suspended the automatic fee increase for the past four years by using existing funds. However, the deposit beverage container deposit special fund under section 342G-104, Hawaii Revised Statutes, is underfunded for fiscal year 2014. The continued operation and existence of the deposit beverage container program is at risk.
The purpose of this Act is to make an appropriation to the deposit beverage container deposit special fund under section 342G-104, Hawaii Revised Statutes.
SECTION 2. There is appropriated out of the general revenues of the State of Hawaii the sum of $ or so much thereof as may be necessary for fiscal year 2014-2015, to be deposited into the deposit beverage container deposit special fund under section 342G-104, Hawaii Revised Statutes, for purposes of sustaining the deposit beverage container program.
The sum appropriated shall be expended by the department of health for the purposes of this Act.
SECTION 3. This Act shall take effect on July 1, 2014.
