A BILL FOR AN ACT
relating to copper theft.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 46, Hawaii Revised Statutes, is amended by adding a new section to part V to be appropriately designated and to read as follows:
"§46- Copper theft of county property; county immunity for injuries to perpetrator. No county entity or county employee shall be liable to any person for any injury caused by electrical shock from contact with any property:
(1) Owned or controlled by the county; and
(2) From which the person committed or attempted to commit theft of copper in any amount, including the commission or attempted commission of theft of copper under section 708-835.7."
SECTION 2. Chapter 662, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§662- Copper theft of state property; state immunity for injuries to perpetrator. No state entity or state employee shall be liable to any person for any injury caused by electrical shock from contact with any property:
(1) Owned or controlled by the State; and
(2) From which the person committed or attempted to commit theft of copper in any amount, including the commission or attempted commission of theft of copper under section 708-835.7."
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
