A BILL FOR AN ACT
RELATING TO PERSONS INVOLUNTARILY ADMITTED TO PSYCHIATRIC FACILITIES TAKING eDUCATIONAL COURSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 334, Hawaii Revised Statutes, is amended by adding a new section to part IV to be appropriately designated and to read as follows:
"§334- Patients involuntarily admitted to public psychiatric facilities; personal attendance at educational courses outside the psychiatric facility prohibited. (a) Any patient at a public psychiatric facility who was admitted involuntarily to the psychiatric facility pursuant to chapter 704 or 706 and who was accused of committing or attempting to commit a violent crime shall not be allowed to attend any educational courses in person outside the physical boundaries of the psychiatric facility. The individual may participate in educational courses online or by correspondence while a patient at the public psychiatric facility only if all of the expenses relating to each course are paid for by the patient.
(b) For the purposes of this section, "violent crime" means any of the crimes included in section 351-32.
(c) The department of health shall adopt rules pursuant to chapter 91 to implement this section."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.
