A BILL FOR AN ACT

 

 

relating to THe hawaii community development authority.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 206E-5, Hawaii Revised Statutes, is amended by amending subsection (f) to read as follows:

     "(f)  The authority may amend the community development plan as may be necessary.  Amendments shall be made in accordance with chapter 91[.]; provided that notwithstanding any law to the contrary, no exemption or amendment to the Kakaako final mauka area plan adopted by the authority on September 14, 2011, or the makai area plan adopted by the authority on September 7, 2005, shall take effect without the prior authorization of the legislature by majority vote of both houses on a concurrent resolution that is submitted by the authority with the following information:

     (1)  A list of all proposed amendments or exemptions to the final mauka area plan or makai area plan; and

     (2)  For each amendment or exemption proposed:

          (A)  The purpose of the amendment or exemption; and

          (B)  A detailed summary of the projected impacts of the amendment or exemption."

     SECTION 2.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
