A BILL FOR AN ACT
relating to construction.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 607, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§607- Actions challenging the validity of government permits or approvals; attorneys' fees and costs. (a) In any civil action in this State where a private party obtains injunctive relief revoking or amending a previously issued government permit or approval, the court shall not award attorneys' fees and costs in favor of a prevailing party and against the recipient of the government permit or approval absent a demonstration that the recipient of the government permit or approval received the permit or approval due to fraud, misrepresentation, corruption, deceit, undue means, or failure to disclose material information; provided that this limitation shall not include attorneys' fees and costs that the court may award as a sanction.
(b) For purposes of this section, "permit or approval" shall be the same as the permits or approvals required by law referenced in section 607-25(c)."
SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
