A BILL FOR AN ACT
RELATING TO LAND USE COMMISSION.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 205, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§205- District boundary amendment approval; automatic reevaluation. Any decision approving a petition for a boundary amendment pursuant to this chapter shall include a requirement that the commission, on the tenth year following the date of the decision, reevaluate its decision on the petition and consider whether the conditions for the petition approval require amendment to conform to the current requirements of this chapter, if:
(1) The landowner is not using the land for which the boundary amendment was sought for the purposes set forth in the petition for the boundary amendment; or
(2) The landowner has not made any good faith effort to begin its use of the land for which the boundary amendment was sought, including preparing subdivision and construction plans, arranging for financing, applying to government agencies, or any other action that may be appropriate for the construction of the proposed operations or development of the land subject to the district boundary amendment."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.
