A BILL FOR AN ACT

Relating to health.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

     SECTION 1.  Section 328J-1, Hawaii Revised Statutes, is amended by amending the definition of "smoke" or "smoking" to read as follows:

     ""Smoke" or "smoking" means inhaling or exhaling the fumes of tobacco or any other plant material[, or]; burning or carrying any lighted smoking equipment for tobacco or any other plant material[.]; or inhaling or exhaling the vapor of nicotine or any other substance from any mechanical heating element, battery, or electronic circuit which simulates smoking."

     SECTION 2.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
