A BILL FOR AN ACT
Relating to state contracts.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 103D, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§103D- Prohibition on contracting with contractors that have committed fraud or certain other crimes. Notwithstanding section 103D-102(b), the State of Hawaii shall not enter into a contract with an offeror or any of its principals or its subsidiaries, unless the offeror, principal, or subsidiary, as applicable, attests to the following:
(1) Within a seven-year period preceding the offer, it has not been convicted of or had a civil judgment rendered against it for:
(A) Commission of any felony, including fraud or a criminal offense in connection with obtaining, attempting to obtain, or performing a public contract or subcontract with any federal, state, or local government entity, including contracts in any state;
(B) Violation of federal or state antitrust statutes relating to the submission of offers; or commission of embezzlement, theft, forgery, bribery, falsification or destruction of records, making false statements, tax evasion, or violating federal criminal tax laws; or
(C) Receiving stolen property; and
(2) Within a seven-year period preceding the offer, it has not been notified of any delinquent federal taxes in an amount that exceeds $3,000 for which the liability remains unsatisfied."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect on July 1, 2014.
