A BILL FOR AN ACT

relating to the office of environmental quality control.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

     SECTION 1.  Chapter 343, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§343-   Fees; assistance in the preparation of assessments and statements. (a)  The office may charge an agency or applicant a fee for assisting it in its preparation of either an environmental assessment or an environmental impact statement.  The amount of the fee shall be based upon the time expended by the office in assisting the agency or applicant.

(b)  Notwithstanding any other law to the contrary, the office shall establish a standardized fee schedule, which shall be posted in a conspicuous place in the office and posted on its website.  The fees established, assessed, and collected by the office shall be exempt from chapter 91."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
