A BILL FOR AN ACT

 

 

RELATING TO VEHICLES.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 291C, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§291C-    Automatic license plate readers; restrictions.  (a)  An automatic license plate reader may be used by a law enforcement agency for the purpose of protecting public safety, conducting criminal investigations, or ensuring compliance with county, state, or federal law.

     (b)  Captured plate data obtained through use of an automatic license plate reader:

     (1)  May be retained for a maximum of one year and shall be destroyed after such time unless such captured plate data is relevant to an ongoing law enforcement investigation, prosecution, or appeal; provided that captured plate data relevant to an ongoing investigation, prosecution, or appeal shall be destroyed within thirty days after the official end of the relevant investigation, prosecution, or appeal; and

     (2)  Shall only be accessed by state and county law enforcement agencies.

     (c)  As used in this section:

     "Automatic license plate reader" means a system of one or more mobile or fixed automated high-speed cameras that capture and convert images of license plates into computer-readable data.

     "Captured plate data" means the global position system coordinates, date and time, photograph, license plate number, and any other data captured or derived from an automatic license plate reader and includes all copies of this captured plate data.

     "Law enforcement agency" means any county police department, the department of public safety, and any state or county public body that employs law enforcement officers.

     "Law enforcement officer" means a sheriff, deputy sheriff, police officer, parole officer, or probation officer."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
