A BILL FOR AN ACT

relating to recyclable materials.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

     SECTION 1.  (a)  The department of health shall develop and implement a three-year recycling pilot program in west Oahu to accept for recycling recyclable items that are currently not easily recycled in Hawaii including:

     (1)  Polyvinyl chloride (#3 plastic);

     (2)  Low-density polyethylene (#4 plastic);

     (3)  Polypropylene (#5 plastic);

     (4)  Polystyrene (#6 plastic);

     (5)  Other plastics including bisphenol A, polycarbonate, and Lexan (#7 plastics);

     (6)  Copy paper;

     (7)  Printer ink cartridges;

     (8)  Laser printer cartridges; and

     (9)  Disposable batteries.

     (b)  In developing and implementing the pilot program, the department of health shall select a private operator based upon:

     (1)  A request for quotation;

     (2)  The amount of materials the operator proposes to recycle;

     (3)  The ability of the operator to recycle the items in subsection (a) with minimal fiscal impact; and

     (4)  Other criteria as determined by the director of health.

     (c)  The program site shall be determined by the director of health and may be operated on state property, private property, or both.

     (d)  The department of health may accept and expend private monetary donations to develop the pilot program required by this Act; provided that any private moneys received and expended shall be accounted for separately from public moneys appropriated and expended pursuant to this Act.

     SECTION 2.  There is appropriated out of the general revenues of the State of Hawaii the sum of $          or so much thereof as may be necessary for fiscal year 2014-2015 to develop and implement a three-year recycling pilot program for items that are currently not easily recyclable in Hawaii.

The sum appropriated shall be expended by the department of health.

     SECTION 3.  The department of health shall submit interim reports on the pilot program to the legislature no later than twenty days prior to the convening of the regular sessions of 2015 and 2016, and a final report to the legislature no later than twenty days prior to the convening of the regular session of 2017.  The reports shall include information and recommendations on the efficacy of and the donations, costs, and expenditures associated with the pilot program.  The final report shall also include a recommendation on whether the pilot program should be made permanent.  The reports may include proposed legislation to support or augment the recycling program established pursuant to this Act.

     SECTION 4.  This Act shall take effect on July 1, 2014, and shall be repealed on June 30, 2017.
