A BILL FOR AN ACT
RELATING TO LABOR.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Section 302D-26, Hawaii Revised Statutes, is amended by amending subsection (b) to read as follows:
"(b) The State shall
afford administrative, support, and instructional employees in charter schools
full participation in the State's systems for retirement, workers'
compensation, unemployment insurance, temporary disability insurance, sick
leave, vacation, leave sharing, and health benefits as well as
additional support and incentives offered by the department, including but not
limited to hard-to-staff incentives, national board certification incentives,
special education teacher incentives, bonuses for completion of probation, and
teacher licensing fees, in accordance with the qualification requirements
for each[.], and including the provisions of any supplemental
agreements entered into pursuant to section 302D-25."
SECTION 2. (a) The department of education and state public charter school commission shall identify all incentives and bonuses provided to public school employees, including charter school employees, pursuant to statute, any master agreements and supplemental agreements entered into between the department of education and the exclusive representatives as defined in chapter 89, Hawaii Revised Statutes, and any supplemental agreements entered into pursuant to section 302D-25, Hawaii Revised Statutes, and indicate the total dollar amount and funding distribution method for each.
(b) The department of education and state public charter school commission shall report their findings, including recommendations on the most efficient and equitable funding distribution methods associated with the incentives and bonuses identified pursuant to subsection (a), to the legislature no later than twenty days prior to the convening of the regular session of 2015.
SECTION 3. There is appropriated out of the general revenues of the State of Hawaii the sum of $ or so much thereof as may be necessary for fiscal year 2014-2015 for the purpose of providing additional benefits, support, and incentives to charter school employees pursuant to this Act.
The sum appropriated shall be expended by the department of education for the purposes of this Act.
SECTION 4. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 5. This Act shall take effect on July 1, 2014.
