A BILL FOR AN ACT

 

 

relating to aquatic resources.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 187A, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§187A-     Aquatic resources special fund.  (a)  There is established the aquatic resources special fund to be administered by the department of land and natural resources.

     (b)  The following shall be deposited into the special fund:

     (1)  Legislative appropriations to the special fund;

     (2)  Nonresident permit fees collected pursuant to section 188-   ;

     (3)  All interest earned or accrued on moneys deposited in the special fund; and

     (4)  Any other moneys made available to the fund.

     (c)  Moneys in the special fund shall be expended for the management and administration of the State's aquatic resources."

     SECTION 2.  Chapter 188, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§188-     Nonresident permit.  (a)  The department of land and natural resources shall establish a nonresident permit program for the fishing, taking, or catching of marine or freshwater game fish by nonresidents of the State.

     (b)  The department of land and natural resources shall issue a nonresident permit upon written application in the form as may be prescribed by the department together with payment of a fee.  The permit fee shall be established by the department and all fees collected shall be deposited into the aquatic resources special fund under section 187A-   .

     (c)  It shall be unlawful for any nonresident of the State to fish, take, or catch any marine or freshwater game fish without first obtaining a permit pursuant to this section.

     (d)  The department of land and natural resources may adopt rules pursuant to chapter 91 to implement this section."

     SECTION 3.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 4.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect upon its approval.
