A BILL FOR AN ACT

 

 

RELATING TO HUNTING LICENSES.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 183D-22, Hawaii Revised Statutes, is amended by amending subsection (b) to read as follows:

     "(b)  The hunting license fee shall be:

     (1)  $10 for any person who has resided in the State for one year or longer, [or who] is a member of the armed forces of the United States on active duty [and] or the spouse [and children] or child thereof, or [who] elects to forgo the exemption provided in paragraph [(4);] (3);

    [(2)  $95 for all other persons;

     (3)] (2)  $50 for a three-day period and $95 for a seven-day period for hunting on a private and commercial shooting preserve for persons who do not meet the requirements of paragraph (1) [or (4); and], (3), or (4);

    [(4)] (3)  Free to [all] any Hawaii [residents] resident sixty-five years of age or older and to [all persons] any person with Hansen's disease who [are residents] is a resident of Kalaupapa, Molokai[.];

     (4)  $3 for any qualified disabled veteran who is a  resident of the State.  For purposes of this paragraph, "qualified disabled veteran" means an honorably discharged veteran who:

         (A)  Upon submitting an initial application for a hunting license, has at least a sixty per cent service-connected disability, as defined by the Veterans Benefits Administration, consisting of:

              (i)  The loss of the use of a lower extremity; or

             (ii)  A disability rating of sixty per cent or more,

              and who is receiving compensation from the United States for the disability; or

         (B)  Is the recipient of a purple heart from the United States Department of Defense; and

     (5)  $95 for all other persons."

     SECTION 2.  Section 183D-23, Hawaii Revised Statutes, is amended to read as follows:

     "§183D-23  Licenses expire when.  All licenses shall expire on June 30 next following the date of issuance, except for licenses obtained pursuant to section [183D-22(b)(3).] 183D-22(b)(2) and (4).  A license issued pursuant to section 183D-22(b)(4) shall expire upon the death of the licensee.  Nothing in this section shall be construed to prohibit the department from suspending or revoking any hunting license."

     SECTION 3.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
