A BILL FOR AN ACT

 

 

relating to hunting.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 183D, Hawaii Revised Statutes, is amended by adding a new section to part I to be appropriately designated and to read as follows:

     "§183D-     No net loss of public hunting areas.  (a)  The department shall not reduce the total number of acres of public hunting area on any island of the State to less than the total number of acres that were designated as public hunting area on the respective island as of December 1, 2014.

     (b)  If the department makes land within a public hunting area unavailable for hunting, the department shall make available for hunting an area of land equal to or larger in size than the area made unavailable; provided that the land made available shall be:

     (1)  Of equal or greater quality wildlife habitat as the land made unavailable; and

     (2)  In as close geographical proximity to the land made unavailable as is reasonable under the circumstances.

     (c)  The department shall provide to the legislature an annual report, which shall provide an explanation of the lands made unavailable for hunting and the lands subsequently made available, no later than twenty days prior to the convening of each regular session.

     (d)  For the purposes of this section, "public hunting area" shall have the same meaning as defined in section 183D-4."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect on December 1, 2014.

Description:

Prohibits any net reduction of public hunting area on each island.  Requires the DLNR to make comparable land available for hunting upon making land unavailable for hunting.  Requires the DLNR to submit an annual report.  Effective 12/01/2014.
