A BILL FOR AN ACT

 

 

RELATING TO HEALTH.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Act 215, Session Laws of Hawaii 2013, is amended by amending section 1 to read as follows:

     "SECTION 1.  (a)  There is established a working group to review issues relating to the transition of oversight of home and community-based facilities from the department of human services to the department of health, including services offered by or issues related to:

     (1)  Community care foster family homes;

     (2)  Adult residential care homes;

     (3)  Adult day care centers;

     (4)  Caregivers of persons with developmental or intellectual disabilities;

     (5)  Adult foster homes;

     (6)  Licensed case management agencies; [and]

     (7)  Fees, rules, and regulations that affect all of these care setting providers[.];

     (8)  Possible license renewal fees for all care homes and foster homes;

     (9)  The services of case managers provided to individuals in care homes and foster homes;

    (10)  The services of Community Ties of America for care homes and foster homes in the State;

    (11)  License requirements for new care homes and foster homes; and

    (12)  Appropriate liability insurance coverage for care homes and foster homes.

     (b)  The working group shall be convened by the chairs of the house of representatives and senate committees on [human services.] health.  The working group shall consist of:

     (1)  The chairs of the house of representatives and senate committees on [human services,] health, who shall serve as co-chairs;

     (2)  [One representative]       representatives from the department of human services;

     (3)  One representative from the department of health;

     (4)  [Four]       representatives of community care foster family homes, of which [two]       representatives shall be appointed by the senate president and [two]       representatives shall be appointed by the speaker of the house of representatives;

     (5)  [Four]       representatives of adult residential care homes, of which [two]       representatives shall be appointed by the senate president and [two]       representatives shall be appointed by the speaker of the house of representatives;

     (6)  [Two]       representatives from adult day care centers, of which [one representative]       representatives shall be appointed by the senate president and [one representative]       representatives shall be appointed by the speaker of the house of representatives;

     (7)  [Two]       representatives of developmental disabilities domiciliary homes, of which [one representative]       representatives shall be appointed by the senate president and [one representative]       representatives shall be appointed by the speaker of the house of representatives;

     (8)  [Two]       representatives of adult foster homes, of which [one representative]       representatives shall be appointed by the senate president and [one representative]       representatives shall be appointed by the speaker of the house of representatives; and

     (9)  [Two]       representatives of licensed case management agencies, of which [one representative]       representatives shall be appointed by the senate president and [one representative]       representatives shall be appointed by the speaker of the house of representatives.

     (c)  Members shall serve without compensation and shall not be considered state employees based solely upon their participation in the working group.

     (d)  The working group shall submit a written report of its findings and recommendations, including any proposed legislation, to the legislature no later than twenty days prior to the convening of the regular [session] sessions of 2014[.] and 2015.

     (e)  The working group shall terminate on June 30, [2014.] 2015."

     SECTION 2.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect on June 29, 2014.

Report Title:

Care and Foster Homes; Working Group; Transition Oversight

 

Description:

Extends the working group established by Act 215, Session Laws of Hawaii 2013, to June 30, 2015.  Changes the composition of the working group, including the chairs.  Requires a report to the Legislature prior to the 2015 Regular Session.  Expands the review of the working group.  Effective June 29, 2014.
