A BILL FOR AN ACT

 

 

relating to fishing.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 188, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§188-     Commercial fishing near Niihau shoreline prohibited.  (a)  No person shall:

     (1)  Fish, take, or catch any marine life for commercial purposes; or

     (2)  Provide vessel charter services for the fishing, taking, or catching of marine life,

within one mile of the shoreline of the island of Niihau.

     (b)  For the purposes of this section, "shoreline" shall have the same meaning as in section 205A-1."

     SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
