A BILL FOR AN ACT
Relating to the University of hawaii.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 304A, Hawaii Revised Statutes, is amended by adding a new section to part V to be appropriately designated and to read as follows:
"§304A- Consolidated report. (a) The University of Hawaii shall submit an annual consolidated report to the legislature, no later than twenty days prior to the convening of each regular session, containing the following:
(1) Annual financial statements;
(2) Non-general fund revenues and expenditures by fund type;
(3) Positions and salaries by collective bargaining unit;
(4) The information required by sections 304A-1004, 304A-2153, and 304A-2689; and
(5) Any other information required by statute; provided that the statute states that the information shall be reported pursuant to this section.
(b) Notwithstanding any other law that requires the University of Hawaii to submit an annual report to the legislature, except for laws that explicitly exempt a report from this section, the report submitted pursuant to subsection (a) may include any other information required in other University of Hawaii reports to the legislature and, if the information is included, shall be considered as the official report to the legislature for that respective reporting requirement."
SECTION 2. Section 304A-1004, Hawaii Revised Statutes, is amended to read as follows:
"[[]§304A-1004[]] Annual
report; executive, managerial, and faculty salaries. The [board of
regents] University of Hawaii shall submit an annual report [to
the legislature] pursuant to section 304A- , containing the
salaries paid to all executive, managerial, and faculty members of the
university, including that paid to the president of the university[, not
fewer than twenty days prior to the convening of each regular session]."
SECTION 3. Section 304A-2153, Hawaii Revised Statutes, is amended by amending subsection (b) to read as follows:
"(b) Any law to the contrary
notwithstanding, the board of regents may authorize expenditures of up to
$3,000,000 annually, excluding in-kind services, from this fund for the
purposes of promoting alumni relations and generating private donations for
deposit into the University of Hawaii Foundation for the purposes of the
university. Any expenditure authorized pursuant to this subsection shall be
for a public purpose and shall not be subject to chapters 42F, 103, 103D, and
103F. [The] Pursuant to section 304A- , the university shall
submit a comprehensive annual report to the legislature detailing the
use of any funds authorized by the board under this subsection [no later
than twenty days prior to the convening of each regular session].
The report shall:
(1) Identify each department of the University of Hawaii Foundation supported by moneys from the fund;
(2) Describe the purposes and activities of each department identified in paragraph (1) and how it participates in fundraising activities and benefits the university;
(3) Provide the total expenditures of each department identified in paragraph (1) by primary expense categories;
(4) Identify all moneys from the fund transferred to any fund of the university and provide a justification of how these moneys are used to benefit the university;
(5) Provide a financial summary of the operating activities of the University of Hawaii Foundation, including revenues and expenditures by major reporting categories; and
(6) Identify amounts and purposes of all expenditures from the University of Hawaii support fund."
SECTION 4. Section 304A-2689, Hawaii Revised Statutes, is amended to read as follows:
"[[]§304A-2689[]]
Annual report. [The University of Hawaii shall submit a report to the
legislature, no later than twenty days prior to the convening of each regular
session, of all] All revenue bonds issued pursuant to this subpart[.]
shall be reported pursuant to section 304A- . The annual report
shall provide a summary of all revenue bonds issued pursuant to this subpart
during the preceding fiscal year."
SECTION 5. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 6. This Act shall take effect upon its approval.
